Are You a Provider or a Deployer? The Question That Determines Your Obligations
Before you can determine what your conformity assessment looks like, you need to understand your role under the Act. The EU AI Act distinguishes between two primary types of regulated parties: providers and deployers. Providers are organizations that develop or substantially modify a high-risk AI system and place it on the market or put it into service. Deployers are organizations that use a high-risk AI system under their own authority in a professional context.
The conformity assessment obligation sits primarily with the provider. The documentation must be kept up to date. If the system changes materially, including changes to training data, core functionality, or the population it serves, the technical documentation must be revised and the assessment may need to be repeated. The QMS must cover the full lifecycle of your AI system. For smaller nonprofits, a QMS does not need to be a bureaucratic behemoth. What it does need to be is written, consistent, and actually followed. Documented procedures for how you test your AI system before major updates, how you log and investigate anomalies, how you train staff on appropriate use and oversight, and how you update your technical documentation when the system changes, together constitute the core of a functional QMS for a small nonprofit operating one or two high-risk systems.

CE Marking and EU Database Registration: The Final Steps
Once your conformity assessment is complete and your technical documentation is compiled, two final steps are required before you can legally deploy the system: issuing an EU Declaration of Conformity and affixing the CE marking, followed by registration in the EU database for high-risk AI systems.
The EU Declaration of Conformity is a formal document in which you, as the provider, declare that your system complies with all applicable requirements of the EU AI Act. It must include identification information for the AI system, a reference to the conformity assessment procedure used, the identity of any notified body involved, identification of relevant harmonized standards applied, the date of issue, and the signature of a responsible person in your organization. The declaration must be made available to market surveillance authorities upon request and kept on file for at least ten years after the system is placed on the market.
The CE marking for AI systems follows the same format as CE markings for other product categories in the EU: the letters CE in a specific proportional format. For software-based AI systems, affixing the CE marking means including it in documentation provided to users, on the system's interface where reasonably practicable, and in any accompanying materials. The marking signifies that the provider has completed the required conformity assessment and that the system meets the Act's technical requirements.
EU database registration under Article 49 must occur before the system is put into service. The EU AI Act database is a publicly accessible repository maintained by the European Commission. Registration requires submitting specified information about the system, including its intended purpose, the categories of data it processes, the geographic markets where it operates, and the contact information for the provider. Registered systems are assigned a unique identifier that must be referenced in the technical documentation and declaration of conformity.
August 2, 2026: The Hard Deadline
The August 2, 2026 deadline applies to all high-risk AI systems being placed on the market or put into service from that date forward, as well as systems already in use that fall under Annex III categories. Organizations that were already deploying high-risk systems before the Act's enforcement date had until August 2, 2026 to complete conformity assessments for those systems. After that date, operating a non-compliant high-risk system in the EU market exposes organizations to fines of up to 30 million euros or 6 percent of global annual turnover, whichever is higher.
If you have not yet started your conformity assessment process and the deadline is weeks away, prioritize a rapid gap analysis to understand your exposure, engage qualified EU AI Act counsel immediately, and determine whether any of your high-risk systems should be temporarily suspended in EU-relevant contexts until compliance is achieved. What Deployer Nonprofits Must Ask Their Vendors
If your nonprofit is a deployer rather than a provider, your conformity assessment obligations are lighter but your vendor due diligence responsibilities are significant. Before using a high-risk AI system from a third-party vendor in EU-relevant contexts, you should verify that the vendor has completed the required conformity assessment, holds a valid EU Declaration of Conformity, and is registered in the EU database.
Many nonprofit technology vendors are scrambling to complete conformity assessments before August 2026, and some are not moving fast enough. If a vendor cannot provide documentation of their conformity assessment status, you face a difficult choice: suspend use of the system in EU-relevant contexts, or accept shared liability exposure if regulators determine the system was operated without proper conformity certification. Neither option is comfortable, but the first is considerably less risky than the second.

That is ultimately a benefit to the people your mission serves.
